1. Zero Tolerance Policy Concerning Use of Drugs and Alcohol – While living at Higher Power Sober Living, Resident is to remain clean and sober at all times, and shall refrain from the use of alcohol, illegal drugs, or prescription drugs for which member does not have a valid prescription. Drug Paraphernalia and off label use, dosing or administration of prescribed drugs constitutes a violation of this rule. Any violation of this rule will result in immediate termination of the Resident’s tenancy.
 
2. Resident agrees that, at request of Higher Power Sober Living, member shall be subject to a drug test, breathalyzer test and room search upon move-in and randomly thereafter. Any violation of this rule will result in immediate termination of the Resident’s tenancy. There is a 2-hour time limit to produce a urine sample. 
 
3. All medications to be taken by the Resident (prescription and non-prescription must be pre-approved by Higher Power Sober Living. Any violation of this rule will result in immediate termination of the Resident’s tenancy.
 
4. The first 30 days of residency at Higher Power Sober Living is a probationary orientation period. During
the initial 30-day period, Resident shall be required to:
– Members that are in intensive outpatient are required to attend 2 outside meetings a week.
– None intensive outpatient members are required to attend 5 meetings a week.
– Join a Home Group and remain active with that group.
– Obtain a qualified sponsor and actively work 12-steps of AA/NA etc…
– Secure employment of at least 32 hours (maximum of 50 hours), be full time student, or be active in at least 20 hours of ongoing volunteer work. 
– Abide by 9 curfew on week days,10 pm on weekends (The curfew may be extended to 11 weekdays, 12 weekends once Resident has fulfilled previously listed requirements.
 
The Resident’s progress will be evaluated at 30 days to determine if continued residency is appropriate.
– Residents are allowed 2 overnight passes a month
– Resident will be eligible for overnight passes after a period of 90 days of admittance date pending managements approval. All requirements must be fulfilled in provision #4 and up to date with rent before this privilege is considered.
 
5. Higher Power Sober Living has a deposit fee before moving in. This fee will only be refundable after 6-months of continuous sobriety and good standing with Higher Power Sober Living management or upon agreement with management due to special conditions. 
 
6. Rent is weekly or monthly. Rooms are rented by the week/month only. Residents—specifically those in arrears —can make daily monetary payments in any sum/amount. To make a payment, see house manager and ensure receipt is provided. Each week begins on Sunday and ends on Saturday. A rent arrearage can/will result in eviction. Provided a client departs sober and in good standing (i.e., packs and carries his own belongings the day he departs, washes and places linen back on his bed, cleans his respective living area, does not return to the premises without permission, etc.) he is likely to receive a refund of any overpayment; anything less will result in a pro-rated refund or no refund at all.
All refunds are given at the discretion of Higher Power Sober Living. Departing clients must allow at least (14) days for the processing of any refund.
 
7. Each Resident will attend the weekly House Meeting
 
8. Each Resident is required to do a scheduled chore shift each week as assigned (VIP). The Resident is required to be up and have his bed made by 8AM and maintain a reasonable level of cleanliness around the house as required by house manager.
 
9. Resident is not to accrue more than four written warnings during his stay. Violation will result in termination of the Tenant’s residency. 
 
10. Unless married or engaged, resident must agree not to have any one-on-one contact with existing partners (group settings are okay) for the first 30 days of tenancy. No new romantic relationships are to be established until management deems it appropriate based on resident’s progress. Affiliation with online dating sites is prohibited as well.
 
11. While residing at Higher Power Sober Living, all visitors must be approved by house manager. 
 
12. No smoking of any kind (including vaporizers) in the house. Smokeless tobacco is allowed inside as long as courteous habits are followed.
 
13. Be respectful of the house and furnishings. No hanging pictures on the walls, etc.
 
14. Disruptive Behavior by the Resident will not be tolerated and will result in immediate termination of the
Resident’s tenancy. Disruptive behavior includes, and is not limited to, the following:
– Physical or verbal abuse/violence
– Destruction of property
– Disrespect to other house members
– Dishonesty with peers or house management
– Theft 
Resident will be held legally and financially responsible for damage to persons and property.
 
15. Consistent with Higher Power Sober Living financial policy, Resident is required to give 30 days written notice before moving out.
 
16. Consistent with Higher Power Sober Living financial policy, Resident is not entitled to any refund if the Resident’s behavior (especially in regard to provisions outlined in the Residential Living Agreement) causes his discharge.
 
17. Members that are asked to leave higher power sober living. Because of behaviors that are not allowed such as any suspicious behavior of substance use, failure to pass or take a drug screen or breathalyzer. Or anything management agrees in suitable for discharge of membership. YOU WILL HAVE 15 MINUTES TO LEAVE THE PROPERTY, OR LAW ENFORCEMENT WILL BE CALLED. You can make arrangements with management about getting the rest of you belongings at a later date.
 
Assumption of Risk, Release & Indemnification
Higher power sober living is not responsible for any stolen or damage property of its members and or guest of members. Higher power sober living will not be responsible for and injury’s to its members or its guest unless higher power sober living is in fault such as not keeping property up to safe standards. All members who bring valuables to the property, house is responsible for their valuables. All residents of higher power sober living are members. YOU DO NOT HAVE RENTERS RIGHTS OR ANY RIGHTS OF TENANTS PURSUANT TO THE MISSISSIPPI PROPERTY CODE AND EXPRESSLY WAVE ANY SUCH RIGHTS IN EXCHANGE FOR MEMBERSHIP PRIVILEGES.
